Terms And Conditions
These Terms and Conditions govern the use of Pekokoko’s website and services and form part of the contract for travel services and packages.
1. Organizer Details and Insolvency Protection
Pekokoko acts as the organiser of package travel and, where applicable, as an intermediary for services provided by third parties. The organiser’s full legal name, registration details, address, email, and telephone number will be indicated in the booking confirmation and on the Pekokoko website.
Pekokoko maintains the statutory security required for package travel so that customers’ payments are refunded and, where applicable, repatriation is arranged if services are not provided due to the organiser’s insolvency. Information on the form and provider of the security, and how to claim, will be provided in the booking confirmation and on the website.
2. Use of the Website and Services
The website and services are intended for lawful use only. Users agree not to misuse the website, interfere with its operation, or attempt to gain unauthorized access to any systems or data.
3. Price, Payment Terms and Changes
The total price of the package or individual services and any mandatory taxes, fees, and charges will be presented before the booking is confirmed. Payment terms, including deposits, final payment dates, and accepted payment methods, will be stated in the offer and booking confirmation.
Optional services or extras (such as excursions, room upgrades, special transfers, or additional baggage) are charged separately. Charges imposed by third parties, such as visa fees, local taxes, or resort fees, are the responsibility of the customer unless explicitly stated to be included.
After the booking is confirmed, the price may be adjusted only in accordance with applicable law (for example due to changes in fuel costs, taxes, or exchange rates) and only if such a right has been expressly reserved. If the price increase exceeds the statutory threshold, the customer has the right to withdraw from the contract without paying a cancellation fee.
4. Booking and Accommodation Terms
Hotels and accommodations listed in travel programs or offers are subject to availability at the time of booking. If a specific accommodation is unavailable, Pekokoko will offer a suitable alternative prior to final confirmation.
Customers must comply with the laws and regulations of the destination country. Certain destinations may have restrictions on alcohol consumption or other activities in public areas.
5. Important Practical Information
- Hotel check-in time: 14:00
- Hotel check-out time: 12:00
- Transport and transfer times are estimates and may vary due to traffic, weather, or road conditions.
Visa requirements are determined by the authorities of the destination country. Customers are responsible for ensuring that passports, visas, and other required travel documents are valid for the duration of travel.
Pekokoko is not responsible for weather conditions or climate-related factors that may affect travel plans, services, or activities.
6. Insurance and Customer Responsibilities
Customers are strongly advised to obtain comprehensive travel insurance that covers at least medical expenses, hospitalization, personal accident, loss or damage of baggage and personal belongings, trip cancellation, trip interruption, and delays caused by transport disruptions. Pekokoko does not provide travel insurance and is not responsible for costs that could have been covered by appropriate insurance. Customers are responsible for ensuring that they are medically fit to travel and for disclosing any pre-existing medical conditions, reduced mobility, or special needs at the time of booking.
Customers must provide accurate personal and travel information and check all confirmations and documents upon receipt. Any costs arising from incorrect or incomplete information will be borne by the customer. Customers are expected to behave respectfully and to follow the instructions of guides, accommodation staff, drivers, and other service providers. Any costs, damages, or penalties resulting from a customer’s misconduct or breach of local laws are the customer’s responsibility.
7. Limitation of Liability
Pekokoko acts, where applicable, as an intermediary between customers and independent service providers such as hotels, transport companies, and activity organizers. Each service provider is responsible for the proper performance of its own services under local laws.
Except where mandatory law provides otherwise, Pekokoko’s liability is limited to direct damages up to the total price paid by the customer for the relevant booking and does not cover indirect or consequential losses such as loss of enjoyment or loss of income.
8. Complaints, Remedies and Termination
Customers must notify Pekokoko and/or the relevant service provider without undue delay of any lack of conformity in the booked services so that the issue can be corrected on the spot where possible. If the defect is not remedied, the customer may be entitled to a price reduction or compensation in accordance with applicable law.
If a substantial part of the travel services cannot be provided as agreed, Pekokoko will, where possible, offer suitable alternative arrangements at no extra cost. If alternatives cannot be offered or are not accepted for justified reasons, the customer may be entitled to terminate the contract and receive a refund for unused services and, where applicable, repatriation.
